Equity Lifestyle Properties/ MHvillage.com billing mobile home owners in advance for utilities in Florida

In January of 2023 Equity Lifestyle Properties and its sidekick MHvillage have been billing homeowners in advance for water and trash . Equity Lifestyle Properties decided to unbundle our water and they did send out the 90 day notice that this was happening but they did not change the prospectus with the state nor did they issue a new lease agreement to its residents. What they did was send out a notice saying our water utilities would be unbundled from the base lot rent and we will take 69.00 off your lot rent and then we will add a rent increase of 55.00 dollars in its place and you will be responsible for paying the water. Heres the problem. Our contract says water is included in our base rent and even though they gave us a credit of 69.00 to pay for it, it just isn’t enough and it should be, because our contract says it’s included. Then when January came they had the water and sewer charges listed separately but they were charges that were for the previous two months Oct through December 2022. October through December our water was still included in our base rent and it’s illegal for any type landlord whether it be residential, commercial or mobile home landowners to bill in advance for utilities. Let it be known that it’s common practice to bill tenants for shared utilities when there aren’t separate meters for each home, but it is illegal to profit one penny on those utilities. We’re in contact with the DPBR on this issue as we speak along with the “ Market Value Pass Through Charge” that ELS makes every time someone buys a new home. We are confident that they will be investigated and held accountable for these two issues as the DPBR have assured us that if our compaints on these two issues are true then they are enforceable violations under their authority. So now its just a waiting game. What Equity Lifestyle Properties should have done and it would have been very easy , was to send out the letter about the unbundling of the water, then re written the lease agreement and then started the 69.00 credit in October so when that utility bill was due in January everyone would have had the money to pay, but Equity Lifestyle Properties business practices are notorious for not following the rules and so they decided to double dip once again and violate mobile homeowners rights in every mobile home park they own across Florida while violating the laws that exist to protect us.
